From what I can tell he's trademarked "macpoker" - i.e. not just Mac on it's own, and not just Poker on it's own.
So I assume you could use the phrase "Mac Poker" on your websites without it infringing, but if you said "MacPoker" - that would be an infringement.
Yeha but the whole Mac Poker refers to playing poker on a Mac. Seems very strange.

Just email Apple's lawyers know that there is a Trademark application pending on their trademark...that should do the trick.
BTW, what happens if Ronald n co decide to set up BigMacPoker.com? what then Daniel?
Would be a very popular room I suspect, and pretty easy to make money on….after all they’ll have plenty filet-o-fish!

I will definitely be keeping everyone here updated on the situation. I let Dan know at dinner the other night that I felt obligated to do so now that I've solicited help in a public way. Dan committed to getting back to me by Friday on how he wants to proceed. I'm just waiting for his communication at this point. Once I know something I will be posting here.
I promised everyone that I would post an update here today. Unfortunately I don't have much to report. Dan texted me earlier today and asked for one more day before submitting a settlement sheet to me. I asked for him to send it today since we agreed on Friday; to at least send a bulleted list of what the terms would be. However, I didn't get anything. So, I guess it's wait and see tomorrow. I'll post again tomorrow if / when I get something.
If the "mac poker" niche is worth taking legal action when you ALREADY hold position 1 and 2 in the serps, their must be some serious money to be made.
I think Dan should expect at least a few more serious competitors.
That's pretty ridiculous that there should even be "settlement" terms. What should you have to do to settle anything? There should be no middle ground here. All litigation should just be dropped by him and, hopefully, attorney fees should be fully paid. If not, I would certainly encourage you to countersue.
As others have wisely pointed out, I would threaten him with pointing out his little trademark request to Apple. I'm sure that would end well for him.
Well the problem with them going to apple is the fear that apple brings the hammer down and crushes Dan and PSO's mac sites as well. (total speculation)
