    Lightbulb Mini-Site Solution To Avoid Trademark Issues !

    Hey folks,

    So I was brainstorming about this this morning. Please note that I don't want this to be a discussion about mini-sites vs regular sites and the whole bonus code issue. This is a discussion on how to avoid brand infringement while ranking extremely high for them.

    Here is the solution I came up with, please provide feedback:
    • Optimize Title Tag as so : <title> Sitename + KW1 - Sitename + KW2 - Sitename + KW3 </title>
    • Use domain that includes part of brand that is not trademarked when possible
    • Include the brand name in the URL (not the domain !)

    Here is how the solution would work in practice,

    sitename: word1word2

    our site homepage : xxxxhttp://word1andrestofdomain.com/word1word2

    Obv I know this isn't as good as having the brand in the domain, but this thread is all about not doing that.

    Please let me know what you think of this solution.

    What makes this any different?

    If they want to claim trademark infringement they will for having 1 word or even 3, or a direct phrase it doesn't matter if you outrank them and they want to stop it they will - and it will happen someday regardless of what plans we can come up with.

    Ride the train until it derails - don't ask questions just go with it.

    With the solution advertised here there is no trademark infrigement. Titan is not trademarked. I don't see how you could get in trouble here. Does anyone here disagree ?

    Well, I still think if they are looking for a reason to take you off a listing that they don't want you outranking them for, they will.

    Thankfully - most of the rooms aren't doing that yet.

    My personal stance is I will just head first into any oppurtunity like this and milk it for all it's worth, but I won't invest much capital into it because it remains a gamble.

    Edit - I do think this strategy would work with rooms like "pokerstars" though because they really don't hold trademark over the concept of "poker celebrities". Again, probably comes down to how you do it, and display it, and even then if they want to I suspect they'd shut you down regardless.

    Trademark is irrelevant. What they consider their mark is.

    The owner of officialtitanrakeback.com will not be a Titan affiliate.

    Except for the word poker, in general using any piece of the brand name is verboten. It won't be illegal, but you won't be able to affilaite with most cardrooms.

    I agree here.

    Except to say that I'll take the oppurtunity while it's available (and not complain when I'm shut down, it is what it is), but the more we talk about it the more non-lazy am's will take notice so have at it, I'm going back to workage.

    You mean in the domain right ? Because you should be able to use whatever you want in your url, you're allowed to structure your site how you want.

    So I could own pokerbonus.com/titanpoker no ?

    See that's the thing, of course you can.

    But, if you read the terms of service which were basically written for a refer a friend program, you actually can't.

    I'm not sure even a trademark lawyer could wade properly through the current environment.
